The SCAR website sells the following products: Clothing and accessories.
The customer declares to have read and accepted the general conditions of sale prior to placing his order. Validation of the order therefore constitutes acceptance of the general conditions of sale.
SCAR products are exclusively intended to be sold to final consumers, natural or legal persons, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Therefore, the customer affirms that he acts as a final consumer and does not intend to resell SCAR products for commercial purposes.
1 - Principles
These general conditions express the entirety of the obligations of the parties. In this sense, the buyer is deemed to accept them without reservation. These general conditions of sale apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.
They are accessible on the SCAR website and will prevail, where applicable, over any other version or any other contradictory document.
The seller and the buyer agree that these general conditions govern their relationship exclusively. The seller reserves the right to modify its general conditions from time to time. They will be applicable as soon as they are put online.
If a condition of sale were to be missing, it would be considered to be governed by the practices in force in the distance selling sector whose companies have their headquarters in France.
2 - Content
The purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by the seller to the buyer, from the SCAR website.
The purchases concern the following products: clothing and accessories.
3 - Products and availability
The products offered are those which appear on the site, while stocks last. Each article is accompanied by a description. Each product is presented on the site in the form of a description listing its main technical characteristics: (use, etc.). The photographs are as faithful as possible but cannot ensure perfect similarity with the product offered.
The products and prices are valid as long as they are visible on the Site, while stocks last. Errors or modifications may exceptionally occur, particularly in the case of simultaneous orders for the same product by several customers. In the event of product unavailability after placing your order, the customer will be informed by e-mail or telephone as soon as possible.
SCAR incurs no liability in the event of stock shortages or unavailability of Products for orders not yet placed by SCAR.
SCAR reserves the right to change the products offered on the Site at any time and without notice.
4 - Price
The prices appearing on the product sheets in the internet catalog are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.
SCAR reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer. The prices indicated in the internet catalog do not include delivery costs, invoiced in addition to the price of the products purchased depending on the total amount of the order.
5 - Payment methods
This is an order with obligation to pay, which means that placing the order involves payment by the buyer.
To pay for his order, the buyer has, at his choice, all the payment methods made available to him by the seller and listed on the site. The buyer guarantees to the seller that he has the authorizations possibly necessary to use the payment method chosen by him, when validating the order form.
The seller reserves the right to suspend all order management and delivery in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment. The seller reserves the right in particular to refuse to make a delivery or to honor an order from a buyer who has not fully or partially paid a previous order or with whom a payment dispute is in progress.

6 - Order
The buyer has the possibility of placing his order online, from the online catalog and using the form which appears there, for any product, within the limits of available stocks.

He will also have to choose the address and the delivery method, and finally validate the payment method.
The sale will be considered final:

Any order constitutes acceptance of the prices and description of the products available for sale. Any dispute on this point will take place within the framework of a possible exchange and the guarantees mentioned below.
In certain cases, including non-payment, incorrect address or other problem with the buyer's account, the seller reserves the right to block the buyer's order until the problem is resolved.

7 - Proof of the transaction
Computerized records, kept in the seller's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is reliable and durable and can be produced as proof.
8 - Order processing and shipping
Except in cases of force majeure or during periods of closure of the online store which will be clearly announced on the home page of the site, shipping times will be, within the limits of available stocks, those indicated below
It may take 2 to 7 business days to process an order. In the event that these shipping deadlines cannot be respected, or if they are not respected, the buyer will be informed by email of their extension.
Shipping times run from the date of registration of the order indicated on the order confirmation email.
Once the order is processed, the order is shipped. The customer is notified by email of the shipment of his order.
9 - Delivery
Except in cases of force majeure or during periods of closure of the online store which will be clearly announced on the home page of the site, delivery times will be, within the limits of available stocks, those indicated below.
For deliveries to mainland France, Andorra, Monaco and Corsica, the delivery time is 2 days on average from the day following that on which SCAR dispatched the order, according to the following methods: Colissimo. At the latest, the deadline will be 30 working days after the conclusion of the contract.
For deliveries in the French Overseas Territories, the delivery time is 11 to 18 days from the day following that on which SCAR dispatched the order, according to the following methods: Colissimo
For deliveries to European Union countries and internationally, deadlines will be communicated to the customer according to each order.
The buyer must make to the seller the same day of delivery or at the latest the first working day following delivery, any claim of delivery error and/or non-conformity of the products in nature or quality in relation to the indications appearing on the order form. Any complaint made after this deadline will be rejected.
The claim may be made, at the buyer's choice:

The Customer is required to check the good condition of the products delivered. Any anomaly noted (missing item, damaged package, broken item, etc.) must be indicated by the Customer to the company in charge of transport and to SCAR within two (2) working days from the day of delivery.
In the event of non-compliance with the agreed delivery date or deadline, the buyer must, before terminating the contract, instruct the seller to perform it within a reasonable additional period.
In the absence of execution at the expiration of this new period, the buyer may freely terminate the contract by email or by registered letter to the address: 57 Boulevard de l'Europe 13127 Vitrolles
SCAR will then be required to reimburse all sums paid, at the latest within fourteen (14) days following the date of termination of the sales contract. If the Product is received after using this option, the buyer must return it according to the return methods provided below.
During delivery of the product, the risk of loss or deterioration of the Product is transferred to the Customer at the time of Delivery. As an exception, the risk of loss or deterioration of the Product is transferred to the Customer when the product is handed over to the carrier when the latter is responsible for transport by the Customer and not by the Company.
If it is impossible to carry out the Delivery, due to an incorrect delivery address or the absence of collection by the Customer of his order from the selected collection point or from La Poste, no reshipment can be carried out and the Customer will be reimbursed within five (5) days from receipt of the order by the Company.
Deliveries are made to the address indicated on the order form. Consequently, the Customer must ensure that they have communicated accurate and complete information concerning the Delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or or intercom numbers, etc.).
10 - Withdrawal
The Customer, a non-professional individual, has a withdrawal period of fourteen (14) days from delivery of his order to return the product(s) to SCAR for exchange or refund without penalty. All costs related to the order, products and shipping costs will be fully reimbursed as soon as possible upon receipt of the returned product, in accordance with applicable law. Only return costs will not be refunded, these costs will be the sole responsibility of the Customer.
As an exception, the return of product(s) will be free only for clothing and accessories if this return is made within fourteen (14) days from delivery of the order. The Product must be returned in its original packaging, in its original condition, new, unworn, unwashed. They must be returned in a condition allowing their re-marketing. Any products that are incomplete, damaged, soiled or have been subject to abnormal use will not be taken back and will not be subject to any refund.

11 - Intellectual property
All brands, logos, photographs, texts, comments, illustrations, video sequences, sounds, computer applications which could be used to operate the Site and more generally all elements reproduced or used on the Site are protected by the laws in force. under intellectual property. They are the full and complete property of SCAR or its partners. Consequently, in application of the provisions of the Intellectual Property Code and international conventions, it is prohibited to represent, reproduce, modify, publish, adapt, exploit all or part of the Site or the elements which compose them on any medium whatsoever. , by any means whatsoever for purposes other than for the personal and private use of the User for non-commercial purposes without prior written authorization from SCAR and its corresponding partners.
Violation of these provisions exposes the User to the sanctions provided for by the Intellectual Property Code and the Penal Code, in particular for counterfeiting of copyright and trademark law, as well as those provided for by the Civil Code. in matters of civil liability.
Other distinctive signs, in particular company names, trade names, brands, domain names reproduced on the Site are the property of SCAR or its partners. Any reproduction without express authorization is likely to constitute usurpation involving the liability of its author on the basis of article 1240 of the Civil Code.
The fact that the Company does not initiate proceedings upon becoming aware of these unauthorized uses does not constitute acceptance of said uses and waiver of prosecution.
12 - Guarantees
All products on sale on the Site benefit from the legal guarantee of conformity (as defined in articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (as defined in articles 1641 et seq. of the Consumer Code). Civil Code), allowing the Customer to return defective or non-compliant products delivered free of charge. 14 - Reservation of title
The Company retains full and complete ownership of the Products sold until full payment of the full price, in principal, fees, taxes and mandatory contributions included.
15 - Partial disability
If one or more stipulations of these General Conditions of Sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their strength and reach.
16 - Applicable jurisdiction/law
These General Conditions of Sale are governed by French law and subject to the jurisdiction of the courts of Marseille, subject to a specific attribution of jurisdiction resulting from a particular law or regulation.
